Terms of use

The terms for reading Bright Learning and subscribing to our newsletter. Written to be read, not just filed.

Bright Learning is an independent publication about AI in education, produced and edited by Sam Naji. It is a small, unincorporated online initiative, not a registered company. These terms are an agreement between you and Bright Learning. By using this website ("the site") or subscribing to our newsletter, you agree to them. If you do not agree, please do not use the site.

1. Who may use the site

The site is intended for adults and for professionals who work in and around education. It is not directed at children, and it is not intended for anyone under 13 years of age (or the minimum age of digital consent in your country). Do not use the site or subscribe if you are under that age. By using the site you confirm you can form a binding contract with us.

2. Using the site

Everything we publish is free to read on the open web. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and read the site for your own information. You may link to our articles and quote short extracts with clear attribution to Bright Learning and a link back to the original.

3. Acceptable use

You agree not to:

  • republish whole articles, or present our work as your own;
  • use automated means to scrape, copy, or harvest the site at scale, or to train models on it, except through our published feeds and where the law allows;
  • attempt to gain unauthorised access to the site, disrupt it, or interfere with other readers' use of it;
  • use the site for anything unlawful, or in a way that infringes the rights of others.

4. The newsletter

When you enter your email address, we send a confirmation link and only add you to the list once you click it (double opt-in). The newsletter is free. Every email includes a one-click unsubscribe link, and you can leave at any time. We do not sell or rent your address. How we handle your data is described in our Privacy Policy, which forms part of these terms.

5. Messages you send us

If you send us a message, tip, or correction (for example through our contact form), you keep ownership of it, but you grant us permission to read it, act on it, and where relevant publish or respond to it as part of our reporting. Please do not send us confidential information you are not free to share.

6. Accuracy, corrections, and no advice

We check each claim against named sources before it runs, but we can still get things wrong. When we do, we correct it openly. The site is provided for general information about AI in education. It is not professional, legal, financial, or educational advice for your specific situation, and you should not rely on it as such.

7. Intellectual property

The articles, editing, design, and the Bright Learning name and brand are owned by Bright Learning or used with permission, and are protected by intellectual-property laws. Names, logos, and quotations that belong to other people or organisations remain theirs and appear here for reporting and commentary. Nothing in these terms transfers ownership of our content to you.

8. Third-party links

We link to other sites and sources. We do not control them and are not responsible for their content, accuracy, or practices. A link is not an endorsement, and visiting a linked site is at your own risk under that site's own terms.

9. Disclaimers

The site is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We work to keep the site accurate and available, but we do not warrant that it will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Bright Learning and the people who work on it will not be liable for any indirect, incidental, special, or consequential losses, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) the site. Nothing in these terms excludes liability that cannot be excluded by law.

11. Indemnity

You agree to indemnify Bright Learning against claims and costs arising from your misuse of the site or your breach of these terms, to the extent the law allows.

12. Resolving a dispute

We would much rather sort out a problem directly than fight about it. So if you have a dispute with us, please contact us first and give us a genuine chance to fix it. Send the details through our contact form, and we will work in good faith to resolve it within 30 days.

If we cannot resolve it that way, you and Bright Learning agree that the dispute will be settled by binding arbitration rather than in court, before a single arbitrator, administered by an established arbitration provider under its then-current rules, in the jurisdiction that applies to Sam Naji as the publisher. This is subject to two exceptions and one choice:

  • Small claims. Either of us may still bring an individual claim in a small claims court if it qualifies.
  • Individual basis only. Disputes are resolved on an individual basis. To the extent the law allows, you and we each waive any right to bring or take part in a class, collective, or representative action.
  • You can opt out. If you would rather not be bound by this arbitration agreement, tell us through the contact form within 30 days of first accepting these terms, and it will not apply to you. Opting out does not affect any other part of these terms.

Nothing here takes away any right you have under the mandatory laws of the country where you live, including any non-waivable right to bring a claim in your local courts.

13. Changes to these terms

We may update these terms as the publication evolves. When we do, we change the date at the top of this page. Continuing to use the site after a change means you accept the updated terms.

14. Governing law

Bright Learning is a small independent publication run by one person, so we keep this simple. These terms are governed by the laws that apply to Sam Naji as the publisher. Nothing here takes away any rights you have under the mandatory consumer or data-protection laws of the country where you live. If any part of these terms is found unenforceable, the rest continues to apply.
